This End User License Agreement ("Agreement") is a legal agreement between you ("User", "you", or "your") and Harshad Gajipara ("Company", "we", "us", or "our") for the use of the "Presets & Filters for Lightroom" mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement.
Subject to your compliance with the terms of this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.

The App is licensed, not sold, to you. The Company retains all right, title, and interest in and to the App, including all intellectual property rights therein. This Agreement does not grant you any rights to the Company's trademarks, service marks, or logos.
By using the App, you may upload or create content, including photos and media ("User Content"). You retain all rights in your User Content. However, by uploading or creating User Content, you grant the Company a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the App and the Company's business.
Your use of the App is also governed by our Privacy Policy, which can be found at https://presetpix.com/help/privacy-policy-prt.html. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
The Company may provide updates, upgrades, or modifications to the App ("Updates"). These Updates are subject to the terms of this Agreement, unless additional terms accompany the Updates, in which case those additional terms will apply. The Company is not obligated to provide any Updates or to continue to provide or enable any particular features or functionality of the App.
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from the Company if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the App and delete all copies of the App from your mobile device.
The App is provided "as is" and "as available," without warranty of any kind. To the maximum extent permitted by applicable law, the Company disclaims all warranties, whether express, implied, or statutory, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the App will meet your requirements, operate without interruption, or be error-free.
To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with your use or inability to use the App, even if the Company has been advised of the possibility of such damages. In no event shall the Company's total liability to you for all claims arising from or related to this Agreement exceed the amount paid by you for the App.
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) arising from or related to your use of the App or your violation of this Agreement.
This Agreement and any disputes related thereto shall be governed by and construed in accordance with the laws of GUjarat, India, without regard to its conflict of laws principles.
The Company reserves the right to modify this Agreement at any time. We will notify you of any changes by posting the new Agreement on this page. Your continued use of the App after such changes constitutes your acceptance of the new Agreement.
