App: Camera Guide: Learn Photo

These Terms govern access to the App, free and premium features, subscriptions, content, and acceptable use.

Important: This starter legal document is provided for general informational and drafting purposes. It should be reviewed and adapted by a qualified legal professional before production use.

1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of Camera Guide: Learn Photo (the “App”). By downloading, installing, purchasing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

These Terms form an agreement between you and the App developer. Apple is not a party to these Terms except to the extent described in the applicable App Store terms or the EULA. Additional rules may apply to purchases, subscriptions, App Store use, and third-party services.

2. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction. If you are under the age of legal majority, a parent or legal guardian must review and accept these Terms and supervise your use of the App.

You may not use the App where prohibited by law or in a way that causes the developer to violate applicable law.

3. Description of the App

The App provides educational lessons, interactive comparisons, photography tips, quizzes, favorites, composition guidance, and explanations about camera settings such as exposure, aperture, shutter speed, ISO, white balance, focus, metering, focal length, image formats, histograms, HDR, and composition.

Some content may be free, while other content may require Camera Guide Pro. Features, lessons, images, plan availability, prices, and content may change over time. The App is intended for education and general information, not as a guarantee of photographic results.

4. Educational Disclaimer

Photography outcomes depend on many variables, including camera hardware, sensor size, lens, stabilization, scene movement, light, distance, editing, weather, device processing, and user technique. Simulated examples and comparison images illustrate concepts but may not exactly reproduce results from your equipment.

The App does not provide professional certification, commercial photography advice, safety training, legal clearance for photographing people or property, or a substitute for reading your camera manufacturer’s instructions. You remain responsible for equipment use, physical safety, permissions, releases, copyright compliance, and local laws.

5. License to Use the App

Subject to these Terms and the EULA, you receive a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to use the App on Apple-branded devices that you own or control, as permitted by the App Store usage rules.

This license is for personal, non-commercial use unless we expressly authorize otherwise. No ownership right in the App, source code, lessons, designs, images, trademarks, or other content is transferred to you.

The App may offer a combination of free lessons and premium features. Premium access may unlock advanced lessons, complete visual comparisons, quizzes, future lesson updates, and other benefits displayed in the App.

We may add, remove, reorganize, improve, or replace content. A purchase provides access according to the product type and StoreKit entitlement, not ownership of individual lessons or a promise that every current feature will remain unchanged forever.

8. Subscriptions and Lifetime Purchases

Available products may include a weekly subscription priced at USD $1.99, a monthly subscription priced at USD $4.99, and a lifetime purchase priced at USD $39.99. Actual localized prices, taxes, currencies, product availability, and introductory offers are determined and displayed by Apple and may differ by region.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current subscription period, subject to Apple’s rules. Your Apple account may be charged for renewal within 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple account settings.

A “lifetime” purchase means access for the commercial lifetime of the applicable App and product, subject to these Terms, technical compatibility, legal requirements, and continued availability. It does not guarantee operation on every future device or operating system and does not transfer ownership of the App.

9. Billing, Refunds, and Restoration

Payments are processed by Apple. We do not control Apple’s payment authorization, billing schedule, taxes, exchange rates, refund decisions, or account restrictions. Requests for refunds generally must be submitted through Apple’s official process.

The App may provide a Restore Purchases function. Restoration requires the same Apple account used for the eligible purchase and depends on StoreKit availability and transaction verification. Consumable products, if ever introduced, may not be restorable.

10. Trials and Promotions

Any free trial, introductory offer, discount, promotional code, or eligibility rule is governed by the offer shown by Apple at the time of purchase. Unless explicitly displayed in the purchase interface, no trial or discount is promised.

Promotions may be limited, changed, or withdrawn where permitted. You are responsible for reviewing the purchase screen before confirming a transaction.

11. Intellectual Property

The App and its original content, including text, layouts, visual systems, icons, software, educational structure, trademarks, and graphics, are protected by intellectual-property laws. Third-party names, camera brands, file formats, and platform marks belong to their respective owners.

You may use knowledge learned from the App in your photography. You may not reproduce or distribute substantial App content, package lessons into a competing product, or claim ownership of our materials.

12. Feedback

If you submit suggestions, ideas, corrections, feature requests, or other feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback without obligation or compensation, provided we do not publicly identify you without permission.

13. Third-Party Services and Links

The App may link to Apple subscription management, App Store pages, email, legal pages, sharing services, or external websites. Third-party services are governed by their own terms and privacy policies.

We do not guarantee third-party availability, security, accuracy, or suitability. Your use of third-party services is at your own risk and may require an internet connection.

14. Updates and Availability

We may release updates, corrections, new lessons, redesigned features, or compatibility changes. Some updates may be required for continued use. Older versions may stop working because of operating-system changes, StoreKit requirements, security updates, or discontinued services.

We do not guarantee uninterrupted or error-free availability. Maintenance, network failures, Apple service interruptions, device limitations, or events beyond reasonable control may affect operation.

15. Privacy

Your use of the App is also subject to the Privacy Policy. The App is designed to store many preferences locally, but purchases, support communications, and platform services may involve additional processing.

You should review the Privacy Policy before using the App or contacting support.

16. Disclaimer of Warranties

To the maximum extent permitted by law, the App and all content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted availability.

We do not warrant that the App will meet every requirement, produce a particular photograph, improve professional income, remain compatible with every device, or be free from errors or harmful components. Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by law, the developer and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, equipment, business opportunity, or photographs arising from or related to the App.

Where liability cannot be excluded, total liability arising from the App will not exceed the greater of the amount you paid for the App during the twelve months before the event giving rise to the claim or the minimum amount required by applicable law.

These limits do not apply where prohibited, including liability that cannot lawfully be limited.

18. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the developer and its affiliates from claims, damages, losses, liabilities, and expenses arising from your unlawful use of the App, violation of these Terms, infringement of another person’s rights, or misuse of educational content.

19. Suspension and Termination

We may suspend or terminate access if you materially violate these Terms, attempt to bypass purchases, interfere with security, misuse intellectual property, or create legal or technical risk. You may stop using the App at any time by deleting it and canceling any active subscription through Apple.

Termination does not automatically create a refund right. Provisions intended to survive termination, including intellectual property, disclaimers, limitations, and dispute provisions, will survive.

20. Governing Law and Disputes

These Terms are governed by the laws applicable to the developer’s principal place of business, excluding conflict-of-law rules, except where consumer law requires another result. Courts with lawful jurisdiction may hear disputes that cannot be resolved informally.

Before filing a formal claim, please contact us with a clear description of the issue and requested resolution. Nothing in these Terms removes non-waivable consumer rights or rights available through Apple’s processes.

21. Changes to These Terms

We may update these Terms for changes in law, features, business practices, or security. The effective date identifies the current version. Material changes may be communicated through the App, an update, or another reasonable channel.

Your continued use after revised Terms become effective constitutes acceptance to the extent permitted by law. If you do not agree, stop using the App and cancel any active subscription.

23. App Store and Platform Requirements

Your use of the App is also subject to Apple’s Media Services Terms and Conditions, App Store Usage Rules, payment requirements, family-sharing rules, device limits, and other platform policies. Apple may suspend transactions, restrict an account, remove an application, or change platform services under its own terms.

The developer does not control the availability of the App Store, StoreKit, subscription-management pages, ratings, reviews, sharing services, or operating-system features. A failure or delay in those services does not necessarily constitute a failure of the App.

You are responsible for maintaining a compatible Apple device, supported operating-system version, sufficient storage, internet access where required, and a valid Apple account for purchases or restoration. Mobile-data charges, internet fees, taxes, and hardware costs are your responsibility.

App Store screenshots, previews, promotional text, and feature descriptions are intended to describe the App generally. Interface details may vary by device, region, language, accessibility setting, subscription status, or App version. Where a purchase screen conflicts with general marketing text, the purchase screen and Apple’s confirmed transaction terms control.
