End User License Agreement (EULA)

App: Camera Guide: Learn Photo

This EULA describes the license granted to you and the conditions that apply when using the App.

Important: This starter legal document is provided for general informational and drafting purposes. It should be reviewed and adapted by a qualified legal professional before production use.

1. Agreement

This End User License Agreement (“EULA”) is a legal agreement between you and the developer of Camera Guide: Learn Photo (the “Licensed Application”). It governs your use of the Licensed Application downloaded through Apple’s App Store.

By installing or using the Licensed Application, you agree to this EULA. If you do not agree, do not install or use it. This EULA supplements Apple’s applicable App Store terms. If there is a conflict, mandatory Apple terms or applicable law will control to the extent required.

2. Acknowledgment

You and the developer acknowledge that this EULA is concluded between you and the developer only, not with Apple. The developer, not Apple, is solely responsible for the Licensed Application and its content, subject to the limitations and disclaimers in this EULA.

Apple is not responsible for providing maintenance or support except as required by law or expressly stated in Apple’s own terms.

3. Scope of License

The developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the Licensed Application on Apple-branded products that you own or control, as permitted by the App Store Usage Rules.

The Licensed Application may also be accessed by other accounts associated with you through Family Sharing or volume purchasing where Apple permits and where the applicable product supports it. No rights are granted except those expressly stated.

4. Ownership

The Licensed Application is licensed, not sold. The developer and its licensors retain all right, title, and interest in the software, design, source code, educational content, visual comparisons, lessons, quizzes, graphics, trademarks, and documentation.

Your purchase of a subscription or lifetime product gives you access according to the relevant entitlement. It does not transfer ownership of the software or content.

6. Educational Purpose

The Licensed Application teaches photography concepts through explanations, practical tips, quizzes, and simulated or representative visual comparisons. It may cover exposure, aperture, shutter speed, ISO, white balance, focus, metering, focal length, histograms, image formats, lenses, and composition.

The content is educational and general. It is not a substitute for a camera manual, professional instruction, legal advice, safety guidance, location permission, model releases, copyright clearance, or commercial consultation.

Actual results vary by camera, lens, sensor, stabilization, lighting, movement, distance, processing, editing, and technique. No specific photographic outcome is guaranteed.

7. Premium Products

The Licensed Application may offer Camera Guide Pro through subscriptions or a non-consumable lifetime purchase. Example United States prices may include USD $1.99 weekly, USD $4.99 monthly, and USD $39.99 lifetime. Apple displays the final localized price, currency, taxes, and applicable offer before purchase.

Subscriptions automatically renew unless canceled according to Apple’s rules. You can manage or cancel subscriptions in your Apple account settings. The developer cannot directly cancel a subscription on your behalf.

Lifetime access refers to access for the commercial lifetime of the applicable Licensed Application and product, subject to technical compatibility, this EULA, legal requirements, and availability. It is not a promise of support on every future operating system or device.

8. Purchase Verification

The Licensed Application may communicate with Apple’s StoreKit services to load products, verify transactions, restore purchases, refresh entitlements, detect renewal or expiration, and handle pending, canceled, revoked, or refunded transactions.

Access may depend on a valid signed transaction or Apple account status. Temporary offline access may be based on previously verified entitlement information where technically appropriate. Attempts to falsify transactions or bypass verification may result in suspension.

9. Maintenance and Support

The developer is responsible for maintenance and support to the extent required by applicable law and as described in available support channels. Apple has no obligation to provide maintenance or support for the Licensed Application.

Support may be requested at support@presetpix.com. Support availability, response times, and language support are not guaranteed. You should not send passwords, payment-card details, device passcodes, or unnecessary sensitive information.

10. Warranty

To the maximum extent permitted by law, the Licensed Application is provided “as is” and “as available,” without warranties of any kind. The developer disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted operation.

If the Licensed Application fails to conform to an applicable warranty that cannot be disclaimed, you may notify Apple, and Apple may refund the purchase price, if any, as required by Apple’s terms. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the Licensed Application.

Some jurisdictions provide mandatory consumer guarantees that cannot be excluded. Those rights remain unaffected.

11. Product Claims

You and the developer acknowledge that the developer, not Apple, is responsible for addressing claims relating to the Licensed Application or your possession and use of it, including product-liability claims, claims that the Licensed Application fails to conform to legal requirements, and claims arising under consumer-protection or privacy law.

This provision does not expand the developer’s liability beyond what is required by applicable law.

12. Intellectual Property Claims

If a third party claims that the Licensed Application or your possession and use of it infringes intellectual-property rights, the developer, not Apple, is responsible for investigating, defending, settling, and discharging the claim to the extent required by this EULA and applicable law.

13. Privacy and Data

The Licensed Application is designed to function without account registration. It may store onboarding status, favorites, quiz progress, selected comparison values, preferences, and entitlement information locally on your device.

Purchases are processed by Apple. Support communications are processed when you voluntarily contact us. The Privacy Policy provides additional details and is incorporated into this EULA by reference.

14. External Services

The Licensed Application may enable access to Apple subscription management, App Store pages, email, legal websites, sharing tools, or other third-party services. Use of external services may require internet access and is subject to the provider’s terms and privacy policy.

The developer does not control or guarantee external services. You must not use them in a manner that infringes rights, violates law, transmits harmful content, or creates unauthorized access.

15. User Content and Device Materials

The core version of the Licensed Application does not require you to upload personal photographs. If a future feature permits importing or viewing user-selected materials, you retain ownership of those materials.

You are responsible for ensuring that you have rights and permissions to use any photograph, image, text, or other material accessed through your device. The developer is not responsible for loss caused by device failure, user deletion, backup settings, or third-party storage.

16. Export and Legal Compliance

You represent that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and that you are not listed on a United States government prohibited or restricted-party list, to the extent these representations are required by Apple’s standard licensed-application terms.

You agree to comply with applicable export-control, sanctions, trade, privacy, intellectual-property, and consumer laws.

17. Term and Termination

This EULA begins when you install or use the Licensed Application and continues until terminated. Your rights automatically terminate if you materially violate this EULA.

Upon termination, you must stop using and delete the Licensed Application. Termination does not automatically entitle you to a refund. Provisions concerning ownership, restrictions, warranties, liability, claims, and third-party beneficiaries survive termination where appropriate.

18. Limitation of Liability

To the maximum extent permitted by law, the developer and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost photographs, business interruption, equipment damage, or loss of opportunity arising from the Licensed Application.

Where liability cannot be excluded, total liability will not exceed the greater of the amount you paid for the Licensed Application during the twelve months preceding the event giving rise to liability or the minimum amount required by applicable law.

Nothing excludes liability that cannot lawfully be excluded.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless the developer and its affiliates from claims, losses, damages, liabilities, and expenses arising from your unlawful use, breach of this EULA, infringement of third-party rights, misuse of educational content, or unauthorized circumvention of purchase controls.

20. Governing Law

This EULA is governed by the law applicable to the developer’s principal place of business, without regard to conflict-of-law rules, except where mandatory consumer law requires another governing law or forum.

Before commencing a formal dispute, you are encouraged to contact the developer and provide a reasonable opportunity to resolve the matter informally.

21. Developer Name and Address

The production version of this EULA should identify the legal name and physical address of the developer or business where required by law or App Store policy. Replace this paragraph before release if such information is required in your jurisdiction.

22. Third-Party Beneficiary

You and the developer acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple has the right to enforce this EULA against you as a third-party beneficiary.

23. Entire Agreement and Severability

This EULA, together with the Privacy Policy, Terms of Use, applicable purchase terms, and mandatory App Store rules, constitutes the agreement concerning the Licensed Application.

If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver.

24. Changes

The developer may update this EULA to reflect changes in the Licensed Application, legal requirements, platform rules, or business practices. The effective date identifies the current version.

Where required, material changes will be communicated through the Licensed Application, an update, or another reasonable method. Continued use after an updated EULA becomes effective constitutes acceptance to the extent permitted by law.

26. Compatibility, Backups, and Device Responsibility

The Licensed Application is designed for supported versions of iOS and compatible Apple hardware. Performance and visual presentation may vary based on device size, orientation, accessibility settings, storage availability, operating-system version, and system services. The developer does not guarantee compatibility with jailbroken devices, modified operating systems, beta software, unsupported hardware, or future platform versions.

You are responsible for maintaining appropriate backups of your device and any information you wish to preserve. Local preferences, favorites, lesson progress, and quiz history may be removed when the Licensed Application is deleted, reinstalled, reset, or affected by device restoration. Apple or another backup provider may retain copies according to your independent settings and its policies.

The Licensed Application should not be relied upon as the sole record of professional training, coursework, purchases, photography assignments, or business activity. Keep independent records where loss would cause material harm.

You are also responsible for using photography equipment safely. Do not operate a camera, phone, tripod, light, or the Licensed Application while driving or in another situation requiring full attention. Follow location rules, manufacturer instructions, and reasonable safety precautions.
