End User License Agreement (EULA)
This End User License Agreement is a legal agreement between you and the developer of 4KVideo Camera Pro. It supplements any applicable Apple App Store terms.
1. Agreement
By downloading, installing, purchasing, or using 4KVideo Camera Pro, you agree to this End User License Agreement (“EULA”). If you do not agree, do not install or use the application.
This EULA applies to the software application, updates, upgrades, documentation, and developer-provided content associated with 4KVideo Camera Pro, unless a separate agreement expressly applies.
2. Acknowledgment Regarding Apple
This EULA is between you and the application developer, not Apple. The developer, not Apple, is solely responsible for the application and its content, subject to the limitations stated in this EULA.
Apple is not responsible for providing maintenance or support services for the application except as required by applicable law. Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, Apple has the right to enforce this EULA against you as a third-party beneficiary.
3. License Grant
Subject to your compliance with this EULA, the developer grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the application on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Usage Rules.
The license is for lawful personal or internal business use. It does not transfer ownership of the application, source code, branding, documentation, or other intellectual property.
4. Permitted Professional Use
You may use the application to create personal or commercial video recordings, including films, vlogs, documentaries, interviews, social-media content, training videos, events, and client work. Your right to commercially use footage does not allow you to resell, distribute, sublicense, or exploit the application itself.
You remain responsible for recording permissions, model releases, music rights, location permissions, privacy notices, workplace policies, and all other rights required for your production.
5. License Restrictions
You may not copy the application except for copies automatically made through normal device or backup operation. You may not sell, rent, lease, lend, sublicense, publish, distribute, host, or make the application available to third parties except through Apple's authorized family-sharing or device-management features where permitted.
You may not reverse engineer, decompile, disassemble, translate, adapt, modify, create derivative works of, discover source code from, bypass encryption in, defeat access controls in, or tamper with the application, except to the limited extent such restriction is prohibited by applicable law.
You may not bypass subscriptions or purchases, forge or manipulate App Store receipts, interfere with entitlement verification, use unauthorized modified versions, introduce malware, probe developer systems, or use the application to violate law or third-party rights.
6. Application Functionality
The application provides video-capture controls using capabilities exposed by Apple hardware and software. Supported features may include manual shutter speed, ISO, exposure compensation, focus control, white balance, exposure and focus locks, zoom, live metering, resolution selection, frame-rate selection, HDR, codecs, bitrate options, stabilization, aspect-ratio guides, microphone routing, audio metering, orientation handling, local recording storage, labeling, playback, and sharing.
Feature availability varies by device model, active lens, selected camera, iOS version, thermal state, storage capacity, audio route, and format combination. The developer does not guarantee that a particular feature or format will be available on every device.
7. Camera and Microphone Access
You authorize the application to use the camera and microphone only after granting the corresponding iOS permissions. Without camera access, the application cannot provide preview or recording. Without microphone access, video may be recorded without audio or audio features may be unavailable.
The application may inspect technical details of available cameras, lenses, microphones, and routes to configure supported recording options. You can revoke permissions in iOS Settings, but doing so may prevent the application from functioning as intended.
8. Your Recordings
You own the original content you create, subject to third-party rights. The developer receives no ownership interest in your recordings merely because they were created with the application.
Recordings may be stored in the application's local library or another destination you choose. You are responsible for exporting, backing up, securing, and preserving important footage. The developer is not a storage or archival service and does not guarantee recovery of deleted, corrupted, interrupted, or lost recordings.
9. Purchases and Subscription License
Some functionality may require a paid subscription or lifetime purchase. A successful purchase grants a license to use the applicable paid features according to the product description shown at the time of purchase, this EULA, the Terms of Use, and Apple's rules.
Subscriptions are tied to the Apple ID used for purchase and may renew automatically. You are responsible for managing cancellation in Apple ID settings. Deleting the application does not cancel billing. Lifetime access refers to the commercially supported lifetime of the application and does not guarantee perpetual compatibility with future devices or operating systems.
10. Updates
The developer may provide updates, bug fixes, security improvements, compatibility changes, or new features. Updates may be automatically installed depending on your App Store settings. This EULA applies to updates unless an update is accompanied by a separate agreement.
Older versions may stop working correctly after iOS, device hardware, Apple APIs, codecs, or App Store requirements change. The developer is not required to maintain compatibility with every previous device or operating-system version.
11. Maintenance and Support
The developer may provide reasonable support through support@presetpix.com. Support availability, response times, supported languages, and scope may vary. The developer is not obligated to provide on-site production assistance, footage recovery, device repair, legal advice, or guaranteed correction of every issue.
Apple has no obligation to provide maintenance or support for the application.
12. Intellectual Property Rights
The application and all associated copyrights, patents, trade secrets, trademarks, interfaces, icons, documentation, and other intellectual property are owned by or licensed to the developer. All rights not expressly granted are reserved.
If a third party claims that the application infringes its intellectual-property rights, the developer, not Apple, is responsible for investigation, defense, settlement, and discharge of that claim, to the extent required by law and subject to this EULA.
13. Legal Compliance
You represent that you are not located in a country subject to a United States government embargo or designated as a “terrorist supporting” country, and that you are not listed on a United States government prohibited or restricted party list, where such representation is required by Apple's standard terms.
You must comply with all local, state, national, and international laws applicable to recording, encryption, export, sanctions, intellectual property, privacy, and use of software.
14. Prohibited Recording Uses
You may not use the application to conduct unlawful surveillance, record private communications without legally required consent, violate court orders, create exploitative content, harass or threaten others, capture trade secrets without authorization, or infringe privacy, publicity, copyright, trademark, or contractual rights.
The developer does not monitor or pre-approve recordings and is not responsible for your content or conduct.
15. Warranty Disclaimer
To the fullest extent permitted by applicable law, the application is licensed “as is,” “with all faults,” and “as available.” The developer disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, reliability, compatibility, and uninterrupted operation.
Professional productions involve risks such as overheating, battery depletion, storage exhaustion, microphone disconnection, focus error, exposure error, corrupted files, unexpected notifications, operating-system interruptions, and hardware failure. You should test the complete workflow before important recording sessions and use backup equipment where appropriate.
If the application fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, according to Apple's policies. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the application.
16. Limitation of Liability
To the maximum extent permitted by law, the developer is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost recordings, lost revenue, lost profits, missed events, production delays, reshoot costs, damaged reputation, data loss, device damage, or third-party claims.
The developer's total liability arising from the application will not exceed the amount paid by you for the application during the twelve months preceding the claim, or the minimum liability that cannot be excluded under applicable law.
17. Product Claims
The developer, not Apple, is responsible for addressing claims by you or a third party relating to the application or your possession or use of it, including product-liability claims, claims that the application fails to comply with applicable legal or regulatory requirements, and claims arising under consumer-protection or similar legislation, subject to this EULA and applicable law.
18. Third-Party Services
The application may enable you to share recordings through Apple or third-party services. Those services are not licensed under this EULA and are governed by their own terms. The developer is not responsible for content after it is transferred to a third-party service.
19. Termination
This EULA remains effective until terminated. Your rights terminate automatically without notice if you fail to comply with a material term. Upon termination, you must cease use and delete the application where required. Termination does not erase obligations relating to prior misuse, payment, intellectual property, liability, or indemnification.
20. Changes to This EULA
The developer may update this EULA to reflect changes in law, Apple requirements, functionality, or business practices. The updated effective date will be displayed. Continued use after an updated EULA takes effect constitutes acceptance, except where additional consent is required by law.
21. Governing Law and Severability
This EULA is governed by applicable law without depriving you of mandatory consumer protections in your place of residence. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect.
22. Entire Agreement
This EULA, the Terms of Use, the Privacy Policy, and the App Store purchase terms form the complete agreement concerning your licensed use of the application and replace prior discussions relating to that subject.
